US Judge Grants Samsung?s Request For Expedited Galaxy Nexus Hearing

Samsung already managed to put the Galaxy Nexus back on the Play Store last week, but today the company?s request for an?expedited appeal against the preliminary injunction has been granted. The process will allow Samsung to submit their court brief by the 16th, giving Apple 14 days to respond. A final court date is set for August 6th, where closing comments and arguments will be made.

This comes just days after Apple sent letters to third-party retailers warning them to halt sales of both the Galaxy Nexus and Galaxy Tab 10.1.

?The letter shows nothing beyond the entirely predictable consequence of Samsung?s infringement ? i.e., the infringing products must be taken off of the market. It is not a legally cognizable harm to halt downstream sales of stolen, pirated, counterfeit, or infringing products.?

With the above statement, Apple attempts to defend itself with strategic legal jargon in which it groups Samsung with thieves and counterfeiters. While it is understandable for the company to remind retailers to avoid selling the Galaxy Tab, the Galaxy Nexus had its ban lifted, meaning retailers can legally sell the device. In fact, retailers can even continue selling the Galaxy Tab until their stock has been depleted. It?s apparent that Apple is beginning to leave a bad taste in everybody?s mouth.
